Terms of Service

IMPORTANT: By downloading, installing, or using the Vazio application ("Vazio"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the app.

1. Acceptance of Terms

By accessing and using Vazio, you accept and agree to be bound by the terms and provision of this agreement. Additionally, when using Vazio's services, you shall be subject to any posted guidelines or rules applicable to such services.

2. Description of Service

Vazio is a mobile application designed to help users track intermittent fasting periods. The app provides timers, logs, and basic analytics related to fasting activities. Vazio is provided for personal, non-commercial use only.

3. Medical Disclaimer - IMPORTANT

⚠️ VAZIO IS NOT A MEDICAL DEVICE AND DOES NOT PROVIDE MEDICAL ADVICE.

No Physician-Patient Relationship: The use of Vazio does not create a physician-patient relationship between you and Vazio (or Andres Rojas). The Services are intended for use only by healthy adults capable of making lifestyle changes.

Consult Your Doctor: You should consult with a qualified healthcare professional before starting any fasting regimen, especially if you have knowledge of any pre-existing medical conditions, including but not limited to:

  • Cardiovascular disease
  • Lung or respiratory disease (including asthma)
  • Diabetes or insulin resistance
  • Neuromuscular disease
  • History of eating disorders (anorexia, bulimia)
  • Pregnancy or breastfeeding

Listen to Your Body: If you experience considerable pain, general malaise, shortness of breath, nausea, dizziness, or any other discomfort while fasting, STOP IMMEDIATELY and consult a doctor.

4. Subscriptions and Purchases

Vazio offers both free and premium features. Premium features are available through auto-renewable subscription plans. All purchases are processed through Apple's App Store and are subject to Apple's Terms and Conditions.

4.1 Subscription Plans

Vazio provides the following subscription options:

  • Weekly: Billed every 7 days
  • Monthly: Billed every 30 days
  • Annual: Billed once per year

Pricing varies by region and will be displayed in your local currency before confirmation. Subscription prices are inclusive of applicable taxes where required by law.

4.2 Auto-Renewal

Automatic Renewal: All subscriptions automatically renew at the end of each billing cycle unless you cancel at least 24 hours before the renewal date. By subscribing, you authorize Apple to charge your payment method on file for the subscription fee plus any applicable taxes.

Subscription Continuation: Your subscription will continue in effect from billing period to billing period until you cancel. Renewal charges occur automatically — there is no action required on your part to maintain your subscription.

Account Responsibility: You are responsible for maintaining valid payment information and ensuring your payment method has sufficient funds. Failed payments may result in subscription suspension until payment is resolved.

4.3 Free Trials

From time to time, Vazio may offer a free trial period for new subscribers. If a free trial is offered:

  • Your free trial will convert automatically to a paid subscription at the end of the trial period unless you cancel during the trial.
  • You will be charged the applicable subscription fee (plus taxes) at the end of the trial period.
  • We will send you a reminder notification before the trial ends and the charge occurs.

4.4 Cancellation and Refunds

⚠️ Uninstalling the app does NOT cancel your subscription.

How to Cancel: To cancel your subscription, you must manage it through your Apple ID:

  1. Open the Settings app on your device
  2. Tap your Apple ID (your name at the top)
  3. Tap Subscriptions
  4. Select Vazio
  5. Tap Cancel Subscription

No Partial Refunds: We do not offer refunds for unused portions of your current billing period. Cancellation takes effect at the end of your current billing period — you will retain access until then.

Refund Requests: All refund requests must be directed to Apple. To request a refund, visit Apple's refund request page. Apple handles all refund requests at their sole discretion.

4.5 Price Changes

We reserve the right to modify subscription pricing at any time. Any price change will take effect at the start of the next billing cycle. We will provide advance notice of price changes through:

  • Email notification to your Apple ID email
  • In-app notification
  • App Store product page update

Your continued use of the subscription after a price change constitutes your agreement to the new price. If you do not agree to a price increase, you may cancel your subscription before the new price takes effect.

4.6 Restore Purchases

If you reinstall Vazio or get a new device, you can restore your previous subscription by tapping Restore Purchase within the app. This will reconnect your subscription to your Apple ID.

4.7 Family Sharing

Family Sharing is not currently available for Vazio subscriptions. Each subscription is linked to the purchasing Apple ID and cannot be shared with family members.

5. Intellectual Property

The Vazio name, logo, application, and all related content, including but not limited to text, graphics, images, code, and software, are the exclusive property of Andres Rojas. All rights reserved.

You may not copy, modify, distribute, sell, or lease any part of Vazio without prior written consent from Andres Rojas. Unauthorized use of Vazio's intellectual property may result in legal action.

6. Privacy & Data

Vazio operates on a "Local-First" principle. Your fasting data is stored locally on your device and optionally synchronized to your personal iCloud account. We do not have access to, collect, or store your personal data on our servers.

7. Limitation of Liability

VAZIO IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND. TO THE MAXIMUM EXTENT PERMITTED BY LAW, ANDRES ROJAS DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE.

IN NO EVENT SHALL ANDRES ROJAS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM (I) YOUR USE OR INABILITY TO USE VAZIO; (II) ANY UNAUTHORIZED ACCESS TO OR USE OF OUR SERVERS; (III) ANY INTERRUPTION OR CESSATION OF TRANSMISSION TO OR FROM VAZIO.

8. User Conduct

You agree not to use Vazio to:

  • Violate any applicable laws or regulations
  • Infringe upon the rights of others
  • Attempt to gain unauthorized access to any portion of the app
  • Introduce malware, viruses, or other harmful code
  • Reverse engineer, decompile, or disassemble the application

9. Termination

We reserve the right to terminate or suspend your access to Vazio at any time, without prior notice, for any reason, including but not limited to violation of these Terms.

10. Changes to Terms

We reserve the right to modify these Terms of Service at any time. We will provide notice of material changes by posting the updated terms within the app or on our website. Your continued use of Vazio after such changes constitutes acceptance of the new terms.

11. Governing Law

These Terms of Service shall be governed by and construed in accordance with the laws of Colombia, without regard to its conflict of law provisions.
